What Is Probate

Probate is the legal process of distributing a deceased person’s assets to their heirs. If the deceased person had a will, the court will follow the instructions in the will. If the deceased person did not have a will, the court will distribute the assets according to state law. 

The probate process can be time-consuming and expensive. It can also be stressful for the family members who are trying to settle the estate. The probate process can take months or even years to complete, and during that time, the assets of the estate are usually not available to the heirs.

Probate Court: A Segment of the Judicial System handling Wills, Estates, Conservatorships, and Guardianships. 

The Probate Court deals with Probate. They administer the distribution of a deceased persons assets to legal heirs or according to deceased persons wishes.

Estate planning is important for all responsible adults, and everyone should have a last will in place at a minimum. If you do not execute any estate planning documents you will die intestate, and the outcome of this is not consistent with most people’s wishes.

When you die without a last will or a trust in California directing the transfer of your assets, the condition of intestacy results. Under circumstances where you pass away without having a will or trust and no living relatives, the state of California would absorb your assets under escheat rules.

Setting up and funding a revocable living trust is prudent estate planning. By placing assets in a living trust, you’re sparing your family the expense and time involved in probate.

But what happens if you’ve acquired new assets that have not been transferred to the trust at the time of death? When someone dies, assets not in their trust must be probated with some exceptions. Assets that move directly to a named beneficiary, such as the proceeds from a life insurance policy, certain types of property ownership, investment accounts with transfer on death (TOD) designations, or retirement accounts would be exempt from probate.

There are several good reasons to plan your estate to avoid probate.
